1. Goated.com

Goated.com (the "Website") is owned and operated by AJM Gaming, N.V. (hereinafter "Goated", "we" or "us") registered under No 161218, at Kaya W.F.G. (Jombi) Mensing 24 Unit A, Willemstad, Curacao.

2. General

2.1. The Terms of Service govern your (the user) usage of the Website and any services provided and is a legally binding agreement between you and us and should be read in entirety before using the Website and any of Goated's services. Your use of the Website constitutes your acceptance by you of these Terms of Service and all other policies by Goated. If you do not accept the terms, do not use, visit or access any part of the Website.

2.2. We may update these Terms of Service at any time. It is your responsibility to continue to check for any updates regularly. By continuing to use the Website or any Services after any amendments to the Terms of Service, you will be considered to have accepted and agreed to be bound by the updated terms. If you do not agree with the changes, you must discontinue using the Services.

2.3. Any games or betting markets made available on the Website as part of the Services may also be subject to their own rules, to which you should also refer to when participating. The provisions of these Terms of Service shall prevail in the event of any conflict with any such rules.

3. Goated Account

3.1. In order for you (the customer/user) to be able to place bets via the Website, you must first register for an account ("Goated Account"). You must enter all mandatory information requested in the registration form and any additional KYC requirements or verifications that may be necessary as per Goated's discretion or legal requirements. It is your sole responsibility to ensure that the information you provide is true, complete and correct.

3.2. You may not register for a Goated Account if:

  1. You are under 18 years old or under the legal age of majority for gambling in the jurisdiction in which you are located;
  2. You are residing or located in jurisdictions from which gambling or your use of the Services is not permitted. It is your responsibility to ensure that your use of our Services is lawful; or
  3. You provide misleading information or try to register for a Goated Account through third parties. You are prohibited from selling, transferring or acquiring Goated Accounts to or from other users.

3.3. You are fully and solely responsible for the security of your login details and other sensitive information, including passwords and cryptocurrency wallets and associated private keys. We are not liable for any loss or damage arising from abuse or misuse of your account by third parties due to your disclosure, whether intentional, accidental, active or passive, of any such information to any third party.

3.4. You are permitted to have only one Goated Account. If you attempt to open more than one Goated Account, any and all such accounts may be blocked, suspended or closed, and any sums credited to those accounts will be frozen. If you realize that you have opened more than one registered Goated Account you must notify us immediately by email at support@goated.com.

3.5. If at any time after registration of your Goated Account you become aware of any errors or incorrect information relating to your Goated Account, you must inform us as soon as possible by email at support@goated.com.

4. Deposits, Withdrawals, Payouts and Bonuses

4.1. You may only partake in Goated services and games if you have sufficient funds for such participation.

4.2. You may only deposit onto the Website your own funds from your own cryptocurrency wallets (or through other payment providers that may be available on the Website) and those funds should not originate from criminal or other unauthorised activity.

4.3. We are not responsible for any deposit delays caused by blockchain transaction times, payment method issues, or third-party factors.

4.4. We reserve the right to use additional methods to verify your identity when processing deposits and withdrawals from your Goated Account.

4.5. Be aware that payment methods may include additional fees, and your bank or payment provider might also charge fees for transfers or currency conversions.

4.6. We may decline any deposit at our own discretion. If your Goated Account is blocked or suspended, do not attempt to deposit funds. Should you attempt to deposit funds when your account is blocked or suspended, you acknowledge and agree to the risk that these funds may be permanently lost and if they are not lost, we have the right to retain them.

4.7. Cryptocurrency withdrawals will be made to your stated wallet address after you make a valid withdrawal request.

4.8. Deposits, withdrawals, payouts and bonuses may be limited if we detect any suspicious, unauthorised, fraudulent or illegal activity related to your Goated Account.

4.9. If your Goated Account is mistakenly credited with a payout or other amounts that do not belong to you or if you are able to access funds on the Website that do not belong to you, due to a technical or human error, such amounts will remain our property and will be deducted from your account. It is your responsibility to notify us immediately by email at support@goated.com if you become aware of or suspicious of any such error. If you withdraw funds that do not belong to you, those amounts will constitute a debt owed by you to us and you are obligated to return it.

4.10. If your Goated Account has been closed, locked, blocked or excluded and you wish to recover funds held in it, please contact Goated customer support at support@goated.com. We reserve the right to refuse to reopen or unlock your Goated Account or to process withdrawals if we suspect a breach of these Terms of Service and our policies. Additional KYC verification procedures and other checks may be required for such a withdrawal.

4.11. Occasionally, we may offer you various bonuses and rewards, such as and not limited to free spins, cashback, free bets and additional funds to play games ("Bonuses"). Any such Bonuses will have its own specific terms and conditions, which you must agree to in order to participate.

4.12. We reserve the right to remove any Bonus from inactive accounts or accounts that we determine, at our sole discretion, are exploiting a Bonus in bad faith.

4.13. We also reserve the right to cancel any Bonuses that have not been claimed within the shorter of any applicable claiming period or 60 days, as well as to cancel any Bonus at our sole discretion.

5. Know your Customer

5.1. We reserve the right to request KYC documentation from you at any time if we deem it necessary to verify your identity, location or age or for any other reason. Until we are satisfied with your identity verification, we may restrict your access to any and all services on the Website, as well as your ability to make payments and withdrawals, at our sole discretion.

5.2. We may disclose your information to third parties as required to comply with legal processes or as permitted under our privacy policy. By using any services on the Website, you acknowledge and consent to the possibility of such disclosures.

6. CONDITIONS OF USE

6.1. As a condition of your use of the Website and its services, you represent, warrant, covenant and agree that:

  1. You are at least 18 years of age and meet the legal age requirement determined by any laws applicable to you for the use of the Website;
  2. You have legal capacity to enter into a binding agreement with us and are not restricted by any form of limited legal capacity;
  3. Your use of the Website and its relevant services is at your sole option, discretion and risk;
  4. You understand and accept that there is a risk of losing funds when using the Website and its services and you agree that we bear no responsibility to you for any such loss;
  5. You recognise that funds in your Goated account are used instantly when playing games and no refunds are provided;
  6. You understand and accept that the market value of cryptocurrencies can fluctuate significantly;
  7. You have not been diagnosed or classified as a compulsive or problem gambler;
  8. You are not currently self-excluded from any gambling sites or premises and you will inform us immediately if you enter into a self-exclusion agreement with any gambling provider;
  9. You are accessing the Website from a jurisdiction where it is legal to do so and will not use the Website and its services from any location where it is prohibited by law;
  10. All information you provide us is accurate, true and complete and you will notify us immediately if any such information changes;
  11. You engage in Goated services solely for personal, non-professional purposes and for recreation and entertainment purposes only;
  12. You participate in Goated's activities and services on your own behalf and not on behalf of any other person and agree to only open a singular Goated Account;
  13. You will not use the Website or services for any illegal activities, as well as activities prohibited by or in breach these Terms of Service and Goated's policies;
  14. You will not collude with or assist others or attempt to or assist any third parties, or use any device, robot, spider, algorithm, software, routine or other method (or anything in the nature of foregoing), in order to defraud us or interfere with the functioning or operational performance of the Website or the Services;
  15. You will not use the Website or Services in a manner that disrupts other users or attempts to gain an unfair advantage, whether specifically prohibited by the applicable rules or not;
  16. You will not disseminate any information which is unlawful, harassing, abusive, threatening, libellous, defamatory, obscene, indecent, inflammatory, racially or ethnically objectionable, pornographic or profane, or any material that could constitute or encourage conduct that would be considered a criminal offence or could give rise to civil liability;
  17. You will only use funds which have been legally obtained and belong to you for deposits and withdrawals into and from your Goated Account;
  18. You acknowledge that we may take steps to detect and prevent unauthorised or illegal activity, through examination of your device properties, geolocation, detection of IP masking, blockchain transaction analysis or other methods;
  19. If you become aware of any suspicious activity related to the Website, you will report it to us immediately via email at support@goated.com;
  20. You acknowledge that we may suspend, block or close a Goated Account and withhold funds if we deem it necessary to assist in the prevention of money laundering or other illegal activity;
  21. You are fully and solely responsible for obtaining your own independent financial, accounting and tax advice, and for recording, reporting, paying and accounting to any relevant governmental or taxation authority for any tax or other levy that may be payable on any winnings or other sums that you receive from using the Website;
  22. You will keep your account and related items including username, password, cryptocurrency wallet private keys confidential and secure and will immediately notify us if your username or password is compromised in any way;
  23. You acknowledge that we can modify or withdraw any of the services offered by Goated at any time without prior notice to you; and
  24. You understand that we are not liable for any outages, slowness, capacity constraints or other deficiencies affecting the telecommunications networks or internet services required for you to access and use the Website.

6.2. We reserve the right to close or suspend your Goated account if you breach any of the above representations, warranties, or covenants, or if we believe such a breach is likely to occur. Additionally, we may close or suspend your account if requested by the police, a regulatory authority, or a court, or if we are unable to verify any of the KYC information you have provided.

7. PROHIBITED USES

7.1. The use of the Website or its services for any form of illicit activity, including money laundering, terrorist financing or trade sanctions violations, is prohibited.

7.2. The Website and its services are not offered to individuals or entities subject to United States, European Union, or other global sanctions or watchlists. By using the Website you represent and warrant that you are not subject to such sanctions.

7.3. Persons located or resident in Australia, the British Virgin Islands, the Cayman Islands, Curaçao, Cyprus, the Netherlands, Portugal, Spain, the United Kingdom, the United States of America and any other location from which use of the Website and its services is not permitted under applicable laws or regulations or where provision of the Website and its services would require licensing or registration or which is embargoed by the United States of America, the European Union or the United Kingdom (the "Prohibited Jurisdictions") are not permitted to access the Website or the Services. These restrictions apply equally to residents and citizens of other jurisdictions while they are located in a Prohibited Jurisdiction.

7.4. Any attempt to conceal your true location through the use of a VPN, proxy, or similar service, or by providing false or misleading information about your place of residence or location, will be considered a breach of these Terms of Service.

8. NO GOATED WARRANTIES

8.1. The Website and its services are provided to you on an "as is" basis. We disclaim any and all warranties, expressed or implied, in connection with the Website and its services. In particular, we provide you with no warranty or representation whatsoever regarding Goated, the Website or its services regarding its quality, fitness for purpose, completeness, or accuracy, and we make no warranty that any service will be uninterrupted, timely or error-free, or that any defects will be corrected. Goated does not represent or warrant that the Website is or will be free from errors, bugs and other defects in its functioning, and that access to services is or will be continuous, uninterrupted, timely, or secure, that the information made available via, contained on or used by the Website is or will be accurate, reliable, complete, or current, or that the Website will be free from viruses or other harmful material. Information made available via, contained on or used by the Website may be inaccurate or incomplete or otherwise unreliable for a variety of reasons, for example as a result of software bugs, data feed interruptions, platform or server downtime, or other issues, and this may cause losses to you by affecting the functioning of the services or the resolution of markets.

8.2. Goated may occasionally test new games and features on the Website. If there are new features or features in beta and if you choose to use these features, you understand that it may be particularly unstable, prone to errors and bugs and other defects and that Goated will not be liable for any losses sustained as a result. These beta features may need to be suspended, discontinued or modified at any time. Any winnings credited to your Goated account which relate to any technical or human error involving this feature may be deducted at the sole discretion of Goated.

9. BREACH

9.1. Without prejudice to any other rights, if you breach any provision of these Terms of Service, we reserve the right to take appropriate action as we see fit, including closer or suspending your Goated account and/or deducting funds from it, terminating our relationship with you under these Terms of Service or any other agreement and/or taking legal action against you.

9.2. You agree to fully indemnify, defend and hold harmless Goated and its shareholders, directors, employees and agents from and against all costs, expenses, losses, damages, claims, demands and liabilities (including legal fees and any other charges) that may be incurred or suffered by Goated or its shareholders, directors, employees and agents, arising in any way from (i) any breach by you of any part of these Terms of Service; (ii) any violation by you of any law or any third party rights; or (iii) your use of the Website and its services.

10. LIMITATION OF LIABILITY

10.1. Under no circumstances shall we be liable for any claims, proceedings, liabilities, costs, losses or special, incidental, direct, indirect or consequential damages (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use or misuse of the Website and its services. This limitation of liability applies (i) regardless of whether the alleged liability is based on contract, tort, strict liability, statutory liability or any other basis, (ii) even in the case of our own negligence, and (iii) even if we have been advised of the possibility of such liability.

10.2. The limitations of liability in these Terms of Service shall apply to the fullest extent permitted under applicable laws.

11. INTELLECTUAL PROPERTY

11.1. We and our licensors hold all rights to the Websites and services, including the code, structure, and organisation, encompassing copyright, trade secrets, intellectual property, and other rights. You are prohibited, within the bounds of applicable laws, from copying, distributing, publishing, reverse engineering, decompiling, disassembling, modifying, or translating the website, or using the Website and its services in a manner that is prohibited by applicable laws or regulations (collectively "Unauthorised Use"). We retain all rights, title, and interest in the Website and services not explicitly granted to you. You agree to be solely responsible for any damage, costs, or expenses arising from your Unauthorised Use. You must immediately notify us upon discovering any Unauthorised Use by any person and assist us with any investigations related to the information you provide.

11.2. The term "Goated," along with its domain names and any other trademarks and service marks used by us as part of the Website and services (the "Trademarks"), are exclusively owned by us. Additionally, all content on the Website, including but not limited to images, pictures, graphics, photographs, animations, videos, music, audio, and text (the "Site Contents"), is our property and is protected by copyright and other intellectual property rights. By using the Website and its services, you acknowledge that you acquire no rights in the Site Contents and/or the Trademarks. Under no circumstances may you use the Site Contents and/or the Trademarks without our prior written consent. You also agree not to take any action that would harm or potentially harm our rights, including our intellectual property rights.

12. GOVERNING LAW AND JURISDICTION

The Terms of Service and any matters relating thereto shall be governed by, and construed in accordance with, the laws of Curaçao. You irrevocably agree that, subject as provided below, the courts of Curaçao shall have exclusive jurisdiction in relation to any claim, dispute, or difference concerning the Terms of Service and any matter arising therefrom and irrevocably waive any right that you may have to object to an action being brought in those courts, or to claim that the action has been brought in an inconvenient forum, or that those courts do not have jurisdiction. Nothing in this clause shall limit the right of Goated to take proceedings against you in any other court of competent jurisdiction, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.

13. SEVERABILITY

If a provision of these Terms of Service is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect the validity or enforceability in that jurisdiction of any other provision hereof or the validity or enforceability in other jurisdictions of that or any other provision hereof.

14. ASSIGNMENT

Goated reserves the right to assign this agreement, in whole or in part, at any time without notice. You may not assign any of your rights or obligations under these Terms of Service.

15. MISCELLANEOUS

15.1. Any waiver by us of a breach of any provision of these Terms of Service shall not be interpreted as a waiver of any subsequent breach of the same provision or any breach of any other provision of these Terms of Service.

15.2. These Terms of Service do not create or confer any rights or other benefits to any third parties.

15.3. These Terms of Service do not establish or imply any partnership, agency, trust arrangement, fiduciary relationship, or joint venture between you and us.

15.4. These Terms of Service represent the entire understanding and agreement between you and us regarding the Services, superseding any previous agreements, understandings, or arrangements between you and us.
